Creighton University Medical Resident FICA Refund Project
Update - January 2013

As of December 31, 2012, the University had received only 72 of the 82 expected refund checks from the IRS.  Because all of the checks must be received in order to accurately compute the interest due to each medical resident, we are unable to begin the distribution process until the remaining checks have been received.  We will, however, continue to update this website as more information becomes available.

Update - October 2012

During August 2012, the University received notice that the IRS approved the medical resident FICA refund claims filed by the University.  The IRS is expected to send the checks for the total refund amounts plus interest to the University during October 2012 and the University expects to begin processing checks to distribute the refunds with interest to the former medical residents during November 2012. Our goal is to have all refunds and interest distributed to the medical residents by the end of the calendar year.

Update - July 2012

Creighton University has filed claims with the IRS requesting refunds of the FICA taxes withheld and paid on medical resident wages for the tax periods beginning January 1, 1995 and ending March 31, 2005.  These refund claims were filed based on questions related to the IRS's stance that medical residents did not qualify for the so-called student FICA exemption.  In March 2010, the IRS made an administrative decision to allow refunds of the employer and employee FICA taxes for properly filed refund requests for the residency periods January 1, 1995 through March 31, 2005. 

During December 2010, Creighton sent letters to all eligible former medical residents containing a consent form which authorized the University to file the claim for the former resident's refund of the FICA taxes withheld during their residency at Creighton.  The University extended the consent form due date in order to maximize the number of medical residents eligible for the refund and over 560 medical residents submitted their consent forms and were included in the University's refund claims.  The first filing of the refund claims was submitted in July, 2011.  As expected, the IRS requested additional records and documents during the subsequent claim review process and the final documentation for the FICA refund claims was filed with the IRS in February 2012.  At this time we are unable to estimate when the refunds will be received by Creighton and distributed to the medical residents.
